Wintty terms of use

This page sets out the terms under which you use wintty.io and buy the paid editions of the Wintty terminal. The licence for the paid editions is the Wintty Paid Editions End User License Agreement (the EULA), served in full at https://api.wintty.io/legal/eula and summarised in plain words on the licence summary page. Where this page and the EULA differ, the EULA governs the licence.

How you buy

Sponsor and Pro entitlements are bought through GitHub Sponsors at github.com/sponsors/deblasis, under GitHub's own terms as well as ours. Pro is $15.00 as a single one-time sponsorship, and it covers 365 days from the day you sponsor. A recurring sponsorship of $1.00 a month unlocks the Sponsor tier. The price you see on GitHub when you sponsor is the price you pay. Pro Enterprise is different: it is licensed to organisations per seat under its own order form, activated with a signed activation file rather than a GitHub sign-in, and it is not sold through GitHub Sponsors.

What you get

A licence, not a sale of the software. A personal licence is issued to one person: you may install and use the edition you are entitled to on up to three devices that you personally own or control, and nobody else may use it under your licence. Sharing your account, sign-in or licence with anyone else is outside the licence, and so is use by or on behalf of an organisation: an organisation needs Pro Enterprise. The free open-source edition is not a paid edition and is not governed by these terms or the EULA; it stays under its own open-source licences, and you can build it and run it forever.

Signing in and keeping access

Paid editions verify your entitlement through a GitHub sign-in. Your sign-in lasts 30 days and renews itself in the background whenever the app can reach our servers. An activated device keeps working offline: after 30 days without contact it shows a reminder you can dismiss, and it keeps working. If your sign-in lapses, the app asks you to sign in again before you can continue. If your entitlement ends, updates stop and the app asks you to sign in again before it can continue.

If a licence is being shared

We look for licences being used by many people; the privacy notice says exactly what we log. A person decides whether to act, never an automatic ban. If we reasonably determine that the licence terms have been breached, we may suspend or revoke the licence. The app then shows a notice saying why and stops being usable until the matter is resolved. If you believe that decision is a mistake, write to [email protected] and we will review it. If a refund is due, it is arranged as the refund policy describes.

Your consumer rights

If you are a consumer in the United Kingdom or the European Union, you have statutory rights that nothing in these terms or the EULA removes or limits: in the UK the Consumer Rights Act 2015 and the Consumer Contracts Regulations, and the equivalent laws in the EU. Wintty must be as described, of satisfactory quality, and fit for purpose. If it is not, you are entitled to a fix, a price reduction or a refund, and the 14-day right to change your mind after buying is set out in the refund policy.

Warranties and liability

Beyond those rights, the paid editions are provided under the EULA: other warranties are disclaimed to the extent the law allows, and liability is capped at the amount you paid for the entitlement in the twelve months before the event. Nothing limits liability for death or personal injury caused by negligence, or for fraud. The shape of this is on the licence summary page.

Changes

The EULA carries a version number and an effective date, and the current version is always at the link at the top of this page. It may be updated. Where a change materially affects your rights, we will take reasonable steps to tell you, for example in the app. Under the EULA, continued use after a change takes effect counts as acceptance of it, and no change reaches back to a dispute that had already arisen.

Law and courts

The EULA is governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep the mandatory consumer protections of the place you live and, where the law provides, the right to bring proceedings there.

The pages, writing and art on wintty.io belong to Ship Digital and to the people who made them. You are welcome to link to anything here. Please do not repost our downloads as your own or point automated traffic at the site in a way that degrades it for others. The site is provided as is.
